Investigation Of Dui Cases - What Driving Patterns Do Police Typically Look For In Dui Cases?

Tuesday, July 31st, 2007

By Darren Kavinoky What do each of these driving patterns signify? Why are they evidence of impairment? The driving patterns that police typically look for have been outlined by the National Highway Traffic and Safety Administration (NHTSA). NHTSA has delineated a number of cues that police officers can look for in detecting intoxicated drivers driving at night. The list presented below represents, in descending order, the visual cues giving rise to the probability that the person observed is driving while intoxicated. Often, police officers will observe several cues in conjunction, which increases the probability that the driver is intoxicated, that is, driving with a blood alcohol content (BAC), over the legal limit. Studies have indicated that cues by themselves or in conjunction with other cues, give rise to a statistical probability of intoxication. However, it must be recognized that these cues are not definitive of intoxication. In fact, the following cues have between a 30-70% probability of not reflecting intoxication. 1. Turning with a Wide Radius: During the turn, the radius, defined as the distance between the turning vehicle and the center of the turn, is greater than normal. For example, in making the turn, the driver may go beyond the designated lane markers of the first lane they are supposed to be turning into. This cue indicates a 65% probability that the driver has a BAC at or above .10%. 2. Straddling Center or Lane Marker: Here, the vehicle is moving straight ahead with the center or lane marker between the right and left wheels. Essentially this means that the lane marker is between the right and left wheels. This cue indicates a 65% probability that the driver has a BAC at or above .10%. 3. Appearing to be Drunk: This factor is determined by the officers visual observations of the driver and most likely includes several different indicators, including: slouching in the seat, tightly gripping the steering wheel, driving with face close to windshield, and drivers head sticking out of the drivers window, in addition to other cues that may present themselves. This cue indicates a 60% probability that the driver has a BAC at or above .10%. 4. Inappropriate or Unusual Behavior: This cue indicates such inappropriate behavior as throwing objects, arguing, and other disorderly actions. This may also include drinking in the vehicle, or urinating on the side of the roadway. Varying Speed: The vehicle alternates between speeding up and slowing down. This cue indicates a 60% probability that the driver has a BAC at or above .10%. 5. Almost Striking Object or Vehicle: The vehicle is observed to almost strike a stationary object or another moving vehicle. For example, the driver may pass abnormally close to another object, which is visually observed by the officer, or the officer observes another vehicle having to maneuver to avoid a collision with the driver. This cue indicates a 60% probability that the driver has a BAC at or above .10%. 6. Weaving: Essentially weaving is demonstrated as driving in a zig-zag pattern, with the vehicle going from one side of the road to the other. This cue indicates a 60% probability that the driver has a BAC at or above .10%. 7. Weaving Across Lane Lines: Extreme cases of weaving when the vehicle wheels cross the lane lines before correction is made. This cue indicates a 60% probability that the driver has a BAC at or above .10%. 8. Driving on Other than Designated Roadway: Here, the vehicle is seen driving off the road entirely, for example in the shoulder or in the dirt, or through turn-only lanes. This cue indicates a 55% probability that the driver has a BAC at or above .10%. 9. Swerving: Swerving occurs in several different situations. For example, a swerve can occur when the car drifts off course and the driver swerves to put themselves back into the lane. This cue indicates a 55% probability that the driver has a BAC at or above .10%. 10. Slow speed (more than 10 mph below speed limit. This cue indicates a 50% probability that the driver has a BAC at or above .10%. 11. Stopping (without cause) in Traffic Lane: Here, the officer cannot observe any identifiable reason as to why the car is stopped in the traffic lane. This most often occurs at intersections because the intoxicated driver needs to make a decision as to which way to go and stops the car in order to do this. This cue indicates a 50% probability that the driver has a BAC at or above .10%. 12. Stopping Problems: Here, the vehicle stops either too far, too short, or stops in a jerky way. This cue indicates a 50% probability that the driver has a BAC at or above .10%. 13. Following Too Closely: Here, the vehicle is following another vehicle without allowing the legal minimum separation between the vehicles. This cue indicates a 50% probability that the driver has a BAC at or above .10%. 14. Drifting: A drift is defined as a straight line movement of the vehicle at a slight angle to the roadway. This cue indicates a 50% probability that the driver has a BAC at or above .10%. 15. Tires on Center or Lane Marker: This occurs where the vehicles tires are observed to be consistently on the center line or either tire is consistently on the lane marker. This cue indicates a 45% probability that the driver has a BAC at or above .10%. 16. Braking Erratically: Here, the driver will either ride the breaks or else brake unevenly or in a jerky manner. This cue indicates a 45% probability that the driver has a BAC at or above .10%. 17. Driving Into Opposing or Crossing Traffic: This cue occurs in several situations: driving in the opposite lane, backing into traffic, driving the wrong way on a one-way street, or failing to yield the right of way. This cue indicates a 45% probability that the driver has a BAC at or above .10%. 18. Improper or Unsafe Lane Change: Here the driver is observed to take risks or endanger others. The driver will frequently or abruptly change lanes without regard to other motorists. This cue indicates a 45% probability that the driver has a BAC at or above .10%. 19. Illegal or Improper Turn: This cue could mean several things: the turn is too fast, jerky, sharp, etc. It could also mean such maneuvers as turning sharply from the wrong lane, making a u-turn illegally, or turning from outside a designated turn lane. This cue indicates a 45% probability that the driver has a BAC at or above .10%. 20. Signaling Inconsistent with Driving Actions: This cue occurs in several situations: failing to signal a turn or lane change, signaling opposite to the turn or lane change executed, signaling constantly with no accompanying driving maneuver. This cue indicates a 40% probability that the driver has a BAC at or above .10%. 21. Varying Speed: The vehicle alternates between speeding up and slowing down. This cue indicates a 30% probability that the driver has a BAC at or above .10%. 22. Accelerating or Decelerating Rapidly: This cue is observed as any acceleration or deceleration that is significantly more rapid than what is required by traffic laws. This cue indicates a 30% probability that the driver has a BAC at or above .10%. 23. Driving Without Headlights at Night: The vehicle is observed to be driven with both headlights off, when the use of headlights would otherwise be required. This cue indicates a 30% probability that the driver has a BAC at or above .10%. 24. Stopping Inappropriately in Response to Officer: This cue is indicated by any number of factors including stopping at an inappropriate location or under inappropriate conditions, other than in a traffic lane. This cue indicates a 30% probability that the driver has a BAC at or above .10%. 8 Ways To Promote Your Business With Tip Sheets

Monday, July 30th, 2007

By Charles Brown Tip sheets are easy to write but can produce huge benefits for your business. I was looking through my files recently and suddenly noticed how many tip sheets I have saved over the years. In most cases, the authors had included their contact information on the sheets that made it easy to get back with them if I became in the market for their services. I think I am fairly typical in the sense that many people save and file worthwhile information. This makes the humble little tip sheet one of the most versatile marketing tools around. So (because I want you to print this and save it in your files) here are a few ideas that you can use to promote your business with tip sheets:Offer your material as freebies to interest potential clients. You can offer them on your Yellow Page ad, your website or on your email signature file. They can be used as bait to get people to opt in to your email or snail mail marketing list. Write your tip sheets in a way that will demonstrate your expertise. This is a promotion tool that proves to the reader you are an expert in your field. Condensed knowledge in this format is far more convincing than any form of paid advertising. Tip sheets make great inserts to go in your publicity kit. It may be the only thing a journalist reads in your kit, but alone it might very well position your pitch newsworthy. Longer tip sheets can be published as a booklet to be handed out to prospective clients. In this form, your booklet can be given away free of charge or can become a separate profit center if you charge for it. Even if you do plan to give your booklet away for free, Robert Bly recommends that you put a price on the cover to increased its perceived value to the recipient. Shorter tip sheets can be published as either online or offline articles. Submit them to sites like ezinearticles.com or to trade publications that serve your clients industries. Post your tip sheet on your own website as content. The more useful information you put on your site, the more people will come to regard it as an information resource worthy of being bookmarked and repeat visits. Use your tip sheets as handouts at workshops or speaking engagements. Never do any public speaking without some sort of free handout. You dont want your audience to forget you or have no way of getting in contact with you at a later date. Remember that I have saved many of these tip sheets for years. Those authors who had the foresight to put their contact information on them can reap the benefits of these sheets years later. Your tip sheet can be printed as a panel on your brochure. People are more likely to hang onto and file your marketing materials if they contain useful information. Remember, even if they have no need for your services now, circumstances may change months or even years from now. If your material is in their files, they can contact you long afterwards. After you have written several tip sheets, you will often find that they almost write themselves. Not only are they a form that appeals to your readers, the process of writing helps you to organize your own thoughts and ideas. COPYRIGHT(C)2006, Charles Brown. All rights reserved. Fat Stripping Lifestyle Tips-10 Ways To Stay Lean For Life

Sunday, July 29th, 2007

By William R. Sukala Let’s get straight down to it: losing fat isn’t easy. You’ve spent hours in the gym slaving away on the treadmill. Your diet consists of bird seed and a few sprigs of alfalfa. You’ve bought every diet book and exercise gimmick on the market, yet nothing seems to work. Don’t despair! There is hope! Arm yourself with these science-based fat loss strategies and keep it off for life! First off, throw away your bathroom scale. It’s not your friend. Don’t focus on losing weight. Focus on losing body fat. Your goal should be to maintain or build muscle tissue and burn away stored fat. Muscle is very metabolically active and pays a higher caloric “rent” in the body just to sustain itself. Fat is nothing more than a metabolic freeloader that burns very few calories to keep itself alive. If after four months your scale weight hasn’t changed but your clothes fit you magnificently, then chances are you changed your body composition for the better. THAT is your goal. People trudge along on the treadmill or bike working in what they believe is their fatburning zone. Unfortunately, the so-called fatburning mode on the bike is the very mode that’s going to keep you fat. Here’s why. While working at a lower intensity, your body burns more fat as a fuel source for the moment, BUT the cumulative calories burned are actually lower than if you’d opted for the higher intensity “cardio” mode. While in the cardio mode, you will burn less fat and more sugar as fuel sources, BUT your overall calories burned will be much greater. In the long-term, you are served much better by exercising at higher intensities and maximizing the calorie burn than focusing on which metabolic fuel source you’re using. Again, the overall CUMULATIVE calorie deficit is what matters and that’s what’s going to have you looking good for summer! Follow these 10 fat stripping tips 1. If you’re completely new to exercise, you must safely develop your fitness foundation then graduate to higher intensities. Doing too much too soon will leave you sore and discourage you from continuing. Start off with a leisurely pace on the bike or treadmill for no more than 20 minutes and do this 3 to 4 days per week. Each week, increase your duration by 5-10 minutes per session until you are up to 45-60 minutes of non-stop cardio exercise. 2. Now that your fitness foundation is in place, start cranking up the intensity a bit with intervals. Intervals are higher intensity sprints interspersed within your regular cardio routine which are designed to get your heart racing and crank up the calorie burning control knob. During your cardio exercise, start off with 1 to 2-minute high intensity bursts and then give yourself 3-4 minutes of active recovery at a lower intensity (keep walking or pedaling). Perform your intervals at an intensity high enough that you can barely speak to the person next to you, preferably an exercise partner who shares your same fat loss goals. 3. After your body adapts to the intervals, now start trying to maintain higher intensities on a continuous basis. The longer you can exercise at higher intensities, the more calories you burn, and consequently, the more fat you pull out of storage. 4. Increase your metabolism with resistance training. That’s right, start lifting weights. If you don’t like weights, try something like calisthenics or any other mode of resistance that will stress your muscles to a degree to which they’re not normally accustomed. The more muscle you have, the more calories you burn both with exercise and at rest. 5. Make small dietary changes you can live with. If you cut out a mere 250 dietary calories per day and burned 250 calories through exercise, this is a daily total of 500 calories. It is known that you must burn 3500 calories above and beyond your normal energy needs to lose one pound of stored body fat. So this 500 calorie deficit over seven days would be one pound of stored body fat burned. 6. Not convinced? One pound of fat loss per week over the course of one calendar year is 50 pounds of FAT LOSS. Notice my terminology did not include the words weight loss. Who cares about losing weight? I can put you on the pigs feet and mayonnaise diet and you will lose weight simply because it’s low calorie, but you won’t lose much in the way of fat. You’ll likely lose your valuable muscle as well as some water weight. Once you go back to eating normal food, you will gain back all the weight and then some. In the long-run the only thing that matters is body composition, and if you can strip fat and hold onto or build muscle, then you are reprogramming your body for life. 7. Waste as much energy as you can. Be as inefficient as humanly possible. In other words, take the long way through life and avoid shortcuts.Do not take elevators or moving walkways. Take the stairs. Walk up steep hills. Carry a heavy backpack. The more effort you spend on activities of daily living, the more fit and lean you will be for life. All calories burned are cumulative. 8. Misery loves company. Find out who your saboteurs and supporters are. Avoid those that will try to undermine and jeopardize your efforts out of jealousy. Surround yourself with positive, supportive people who encourage your efforts. 9. Make it fun. Frankly, it doesn’t matter what kind of exercise you like. Find the one you enjoy, the one you’ll stick with, and do it regularly. I used the bike and walking example above, but to the extend that you lead an active lifestyle with the calorie burning control knob cranked all the way up, you WILL lose fat and keep it off. 10. The media is NOT your friend. Cancel your cable TV subscription or at least stop watching it. Stop reading fluffy celebrity magazines. These are loaded with unrealistic body images that are merely airbrushed photos meant to provide false hope and sell copies. FINAL THOUGHTSIn my 17 years as a health and fitness authority, I can tell you with 100 percent certainty that everyone I’ve worked with that’s simply committed themselves to doing the right type of exercise and was consistent with it obtained a fitter, healthier body. The trick to fat loss is that there IS NO TRICK. Consistency, hard work, and the proper type of exercise will always win out over the fad diet books and late night infomercial gimmicks. William R. There Are More People Online Than Ever… But Please Remember This…

Thursday, July 26th, 2007

By Paul Ashby They are not there to see your advertisements! Please try to bear in mind that “yes” they do use search engines but they go there to look for something else, somewhere else to gomost certainly they do not go there to see advertising! In “Marketing Myopia” Theodore Levitt wrote: “The reason (the railroads) defined their industry incorrectly was that they were railroad oriented instead of transport oriented. What the railroads lack is not an opportunity but some of the managerial imaginativeness and audacity that made them great. Even an amateur like Jacques Barzun can see what is lacking when he says : “I grieve to see the most advanced physical and social organisation of the last century go down in shabby disgrace for lack of the same comprehensive imagination that built it up”. Much the same could be said about the advertising industry, advertising agencies have ignored Interactive Communication forever that is because they are in love with creativity and media manipulation and have completely forgotten the process of communication. Interactive Communication is marketing from the customer’s point of view. The Internet represents a new marketing dynamic, where the market, does not give one dam about Top-Down-Management together with its convoluted, self-deluded marketing packages. But hey, here they go again, pouring huge sums of money into Internet Advertising, poor deluded fools, they haven’t cottoned onto the fact that they, the market, could not care less about their slick, glib, glittery advertising programmes. Instead of Advertising-as-Usual Advertising Agencies should be encouraging their Clients to indulge themselves with Interactive Marketing Communicationbecause Interactive Communication is a powerful technique much better suited to effective communication than Top-Down demographic slicing so typical of broadcast media. Interactive Communication would enable companies to stop marketing completely by that I mean in the sense of marketing to and marketing at because it would repersonalise the communication process connecting people (but most certainly not Top-Down-Management) to each other. When you start to produce interactive advertising “Events” your customers start talking to you, yes, having conversation with you, and that is when you really will be making significant progress! All advertising is a form of learning whereby you are asking people to change their behaviour after learning the benefits of the products or services you offer. However, we all tend to filter out information, which we do not want to hear. This clearly alters the effectiveness of conventional advertising in quite a dramatic way. The final purchase decision is invariably a compromise and this leads to a certain amount of anxiety; the worry that perhaps the decision was not the best or the right one. In order to minimise this anxiety the purchaser seeks to reinforce their choice and begins to take more notice of their chosen products marketing communications. Due to a lack of understanding of the communication process we have created a media society during the past 40 or 50 years, where the whole process has been de-humanised. There is now an extraordinary reduction in interaction because conventional advertising and marketing have become a one-way practice whereby information is disseminated in a passive form. But, people still have this desire to be taken account of. To affect change, to learn and personalise their relationship with their environment. There are a phenomenal number of reasons that cause people to interact, going far beyond just giving them things. When people agree to participate in truly interactive marketing programmes they are told that their efforts and feedback are of positive help to the advertisers. And most important to the advertisers, by participating and becoming involved, they then learn and understand the advertising message and do so at their own pace and to fit in with their schedule. Consequently, because they are being involved in the process of developing the product or service, it starts to re- personalise their relationship with the advertiser and their products. This takes the consumer through the barrier of not wanting to address change and takes that compromise, the anxiety and worry that perhaps the decision was not the best or the right one, out of the equation. In other words, there is no reason why they should not change from their usual brand in favour of this alternative that they have now learned, fulfils their needs better. And this isnt this the ultimate market the advertiser is after the people who use his competitors products. Now the consumer can say, Yes, I will change my behaviour and I have a very good reason or series of reasons why. They can adopt this position because they have a well-in-formed opinion or have developed an image of why that product is appropriate for their needs. Now the long silence the industrial interruption of the human conversation is coming to an end. Paul Ashby pioneered interactive communication to the advertising and marketing communities some twenty-five years ago. The communication issues he addresses have been neglected during the explosive grown of advertising in the 60s, 70s and 80s, these are Cognitive Dissonance, Selective Retention and Selective Exposure. Would you like to discover the incredible results to be attained by using interactive communication? How To Deal With Jealousy

Saturday, July 14th, 2007

By Oh Srichaphan Most of us have experienced a jealous partner and many of us have found ourselves being insecure or jealous in a relationship, no matters how enlightened we think we are. Jealousy is instinctive. Its a form of fear and insecurity. You suspect your partner of having an affair and youre afraid of losing him/her so you act out to try to protect yourself from losing the relationship. But what many dont realize (or temporary forgetting when they exhibit the jealousy rages) is that theyre more likely to destroy the relationship theyre trying to save. If you are the jealous type of person, the first step you have to take is start communicating more. Stop assuming and start asking questions. Talk about your feelings and try to work it out with your partner. If youre at the receiving end of the jealousy, you also need to communicate and leave all doors open, meaning you must not have keep anything hidden or locked away from your partner but instead have open lines of communication. Resolve the mysteries of the past, discuss your feelings in the present and plan the future by communication and your relationship will be a big success. Jealousy only brings you further apart.
